Making a claim for lost iPhone 4

    Hi,
    I lost my iPhone in Dublin City Centre somewhere between leaving work and getting in my car tonight. Im presuming its now been taken because its turned off and the battery was @ %90 when i left work.
    I am going to make a claim tomoro morning and report it missing to the Garda.
    I am just worried about making this claim because its seems that o2 reject a lot of claims by putting them down to 'negligance'.
    Does anyone have any experience with this and will my claim to accepted??
    If not what should i report the lost phone as??
