Am I eligible for the dole?

    Hi,

    I am working 25 hours per week in a service industry job where I am being bullied and abused by the management. I have endured the place for almost 4 years but recently I can't take it anymore. I would like to quit my job but I would like to know if I can get the dole for a while until I get a new job? I am single and living independently.

    I would think that you would be eligible for Jobseekers Benefit. You may have to serve a disqualification period in view of the fact that you will be giving up your job. This disqualification can be exempted if you give the full facts of the bullying and abuse when you apply for jsb. SW will under these circumstances send a form to your employer to find out why you left your job and then make a decision on disqualification. The most you will be disqualified for is 9 weeks.

    If you bring your problems to the attention of management and they refuse do do anything, and after doing all that you can you feel you have no alternative but to quit, that may be constructive dismissal. In that case there should be no issue with welfare as long as you take a case for constructive dismissal. In any case seek legal advice before you make any decisions.
