    Can someone be prosecuted for clipping someone elses wing mirror (but doing no damage)on a forecourt of a petrol station if witnessed by a garda? What would fine be like if the garda brought such a case?

    The forecourt is a 'public place' as regards RTA. The other guy would have to exchange insurance details and all and would seem to be 100% liable for collision and damage. There is unlikely to be an element of criminal recklessness or carelessness for what you're suggesting though.

    Off duty Garda was in car that was clipped and driver of car that clipped it was argumentative when talking with Garda after inspecting wing mirror which was undamaged.

    He isn't very impartial if he's in the vehicle. Why would he attempt to make an issue of it if there was no damage. Can't see the problem OP.

    Off duty Garda was in car that was clipped and driver of car that clipped it was argumentative when talking with Garda after inspecting wing mirror which was undamaged.

    If he brought it to court, he'd get a bollocking from the judge for not knowing better as a Garda than wasting the courts time tbh

    Read it again, it was the Garda's car that was clipped. Not him clipping a car.

    Mis-understood the context.

    Yeah but surely a guard cant be the prosecuting guard when its his own car that was tipped off? Obviously he would need to get a different cop up from the station to take all the details.

    And if the guard was clever enough he would go to court as a civilian and not a garda. Its all a bit over the top though.

    Off duty garda was passenger in car. My relation who this happened to said Garda was annoyed that guy had driven car inbetween rows of cars that were filling up in order to get to parking area of garage/shop even though there was no markings on forecourt to direct flow of traffic. Garda flashed badge and mentioned careless driving,relation got argumentative and walked off. No other gardai were called and no names or addresses were exchanged.

    He may as well been a trolley boy. He was out of line flashing. I can picture it now. "Judge. They clipped my mates wing mirror in an area of confined space, he was reckless and careless" Judge " bend over Garda"
