If one had insurance,tax,NCT but Learners Permit was expired

    If one was to be stopped at a check point and told to produce their license at the Garda station, what would happen if the license produced was a learners permit which had expired 2 months previously?

    Would the Gardai still consider this failing to produce a license?

    Would they simply tell me to get it renewed?

    Also,if the Garda who made the stop at the check point didnt ask the driver for his name,would he still be able to send a summons based on the registration of the car alone?

    And what is the fine for driving on an expired learners permit?And driving with out a full license holder?The interweb says minimum 1000 euro fine while people ive spoken to say its a maximum 1000 euro fine so im a little confused

    They could do either. But most likely they will consider it a failure to produce and an offence of driving without a licence.

    For a licence which has expired less than 12 months ago, maximum fine is €1,000.

    And if the maximum is 1000 euro fine,what would the typical fine be,200?500?

    Hate to tell u but you insurance is not valid without a licence either.

    One year ban for that ;-(

    Get a solictor & a barrister.

    It will cost but you could be in trouble without.

    Could depend on the garda! If he was a local one and he knew you, you might get off the hook and ask you to get it renewed.

    Ive read this a few times and ive also read that I am covered by my insurance even if my license is expired,so I dont know what to believe but thanks for the input anyway

    I think so.

    No idea. Depends on the judge's mood and a whole pile of other things. If you end up in court, do your best to get your full licence ASAP, to demonstrate that you're not a poor driver and you just made a stupid mistake.

    ^^ Do this, it might just sway the Garda into letting it slide. However, that won't change the fact you had no driving licence or Learner Permit at the time stopped and the Garda would be well within his duty to see you in court.

    Regardless of what happens, renew the permit asap and book your test, you might improve matters for yourself if you can show a shiney new driving licence.

    Btw, did you have L-plates up 'cos the Garda may have made a note of that (unlikely since he didn't even take your name).

    Don't think so. I renewed mine yesterday (10 year full), all details the same and they said I'd get it in about 3 days in the post.

    While the insurer is obliged to cover third parties, you may find yourself in a whole lot of pain regarding your own losses.

    You are legaly obliged the have third party insurance. Your insurance company is legally obliged to provide third party insurance on a policy even if you lied on your application. Therefore you are covered in the eyes of the law. That is not to say the insurance company cannot then cancel your policy and look to recoup the cost of damages to a third party from you.

    Yeah I've heard it said a couple of times on boards that they print licences on the spot, but I don't know anyone personally who's ever experienced it. Perhaps only one or two the of tax offices do this?

    I had my full license printed on the spot in Cork. This was about 3/4 years ago.
