Farm Insurance liability

    Following Scenario

    My cattle break out onto the road and walk into my neighbours lawnand damage it but their private gate is wide open. Am I 100% negligent. I have always being of the opinion that I am 100% liable for damages, is this the case? Surely the private house owner has a duty of care to close their own gate aswell though.

    Secondly, if my cattle are chased and driving out onto a road by roaming dogs (who I know the owners of) am I still negligent if they damage a neighbours lawn same as above. The private household claim from my insurance and I chase the dog owners for compensation to cover the claim against me. Is this right?

    In the first case, you are the animal owner and you are liable if they damage another's property. The question of their gate being open/closed or not existing does not matter. if your fencing was defective, then you must pay up.

    In the second case, there is a defence. You may not be liable and and tell your insurers about the dog. let them chase up the dog owners, rather than you as they have the time, you don't! Hopefully the dog owners have insurance.
