slander on fbook?

    iv recently found out about alot of stuff been wrote about me on the social networking site. people including my estranged wife are posting alot of horrible and untrue comments. how can i stop this? tried the report abuse thing on the site and cannot contact anyone running the site. anyone got any info to help me stop these liars and bitter excuses of people? maybe im inthe wrong forum?

    Just re Facebook, is it possible to trademark your name and picture and thus force Facebook to remove all images and comments about you or face legal action.
    If Karl done that could he then demand everthing be removed.

    Just curious....Wasn't there a case something similar here? What was the outcome?

    FB makes sure you agree to all of the terms and conditions for use which includes signing over all rights to any photos you upload.

    You can trademark your own name in order to distinguish your goods or services from those of another under the 1996 Trademarks Act but it's pointless as the I would have thought that in this context it would be far too costly!

    It costs €75 to register and €150 (ish) on successful registration and this is only for Ireland. You would have to register it as a TM in the USA which would cost alot more and require services of a US lawyer. Not worth the effort in my opinion.

    It sounds like it's a straight case of defamation. A solicitors letter to the individuals' involved would probably sort it out. If not, sue them for defamation.

    Yea in Karls case he should certainly go to a solicitor.

    Just in relation to my own question, I was taking about pictures of you uploaded by other people without your permission not uploading your own pictures. The question is can you block facebook from distributing your picture without permission.

    Not in general. There are a few specific cases where the subject of a photo may have rights to prevent its publication:
    • if the photo is being used to defame them
    • if the photo is used to advertise a commercial service
    • if the photos invade their privacy (i.e. not taken in a public place)
    Other than that people can publish whatever photos of you they want taken in a public place and there's nothing you can do about it.

    Trademarks and copyrights are completely separate things. Trademarks apply to commercial use and apply to a specific narrowly defined area only.
