penalty points

    hey all. i think i may have been caught doing approx 55KPH in a 50 zone this morning by a cop. i think as i was passing he was swingin the camera up on to his shoulder. im almost sure he was but i could be wrong. likewise i am almost sure i was doing 55 or more....i definately wasnt boy racing by any means. this has never happened me before so can i anyone tell me if i ll have to go to court? i know i ll have to pay fine and penalty points. how long does it take for that fine to come in post?

    If you pay the fine and take the points, you don't need to go to court.

    The fixed penalty notice can come anytime up to 6 months after the incident, normally though it's 2-3 weeks.

    Were you actually stopped and spoken to by the Garda?

    no he didnt stop me, and im almost sure the camera wasnt fixed.

    no, he didnt stop me. I would have assumed i wouldnt have had to be stopped to be fined? will be pretty pissed off i am...i am a careful driver and this could be my first offence while boy racers are getting away with serious stuff.

    This argument is possibly the stupidest argument ive ever heard. And what's worse, people use it so frequently. By the same logic no Garda should investigate any crime until all murders have been solved.

    very sorry seanbeagi respect your right to put your view out there. I tell u what, regardless of weather or not i ve gotten these points i ve learned my lesson...i was drivin a route i drive every day and familarity breathes contempt as they say. I will adhere to the EXACT speed limit from now on and if i DO get fined i ll pay it. And driving 5km over the speed limit is not the same as murder.

    Speeding offences: an fixed charge fine of €80, together with 2 penalty points. If you have been caught speeding on police traffic camera, you will receive notice of your fine and penalty points of the offence by post. You have 28 days in which to pay your fine from the date the notice issues to you to pay your fine. If you do not pay your fine, the fine then increases to €120 which you must pay within 28 days. If after this time (56 days) you still have not paid your fine, the offence is referred to the courts. If you are convicted in court of speeding offences and non-payment of fines, you will automatically receive 4 penalty points and a fine up to a maximum of €800.

    you wont be getting points...
    • The guard would have stopped you
    • the guard would be a bad ******* to do you for 5km over the limit.
    • usually when your car tellos your doing lets say 100kmph, ur actually only doing about 96

    na, the fine would have to come well before 6 months, it has to give you the 90days to pay. if it came on 5.5 months and you didnt pay it, it would go "statute barred" and you couldnt be prosecuted for it.


    bottom line is, it is very unlikely you will be getting a fine.

    Because the Gardaí would not be able to raise a summons if you did not pay as 6 months would have elapsed during the period allowed to pay.

    If the fine comes on within 56 days of 6 months of the alleged offence then you can run the clock down.

    If a summons comes within 6 months (i.e. 5 months 30 days) then you are still within the limitation period.

    yes the 90 days to pay the fine starts when the ticket is issued. at this has nothing at all to do with court.
    after the 90 days the FCPS centre will apply for the summons if the fine isnt payed, but this can only be within 6 months of the offence.

    the summons has to be applied for to the court within 6 months of the offence, not 6 months of the ticket being issued,


    if a guard issues a ticket and dosnt allow the 90 days, the fcps centre rejects it. fact

    exactly, othrwise the summons is applied for, the persons pays the ticket 2 days later and still gets a summons.... dosnt make sense
