P45 issuing: timescale

    I'm leaving my job this week.

    HR have just confirmed they won't issue a p45 until the 1st September.
    Is that right, can they leave it that long?

    I won't be in the county then which is why I'm concerned, we're emigrating at the end of August...

    as far as im aware P45 takes 5 mins to complete

    It's typical for an employer to issue the P45s after the payroll run. While you're leaving next week, the payroll run probably isn't till the end of August, hence the 1st September P45 date.

    Informally this is OK, even though the requirement is that employers must provide the last paycheque, payslip and P45 together, as soon as possible after the employee has left.

    So strictly speaking they can't make you wait until 1st September. If you make enough noise and explain to them that you won't be in the country, they might sort it out. Otherwise, wait until you've left and then ring revenue and explain that your employer is refusing to issue a P45. You'll get it sharpish then.

    I was waiting about 2 months for my P45.After many phonecalls to the company asking for it and the same excuses (forgot to post it, lost my address...) I decided to ring to tax people and explain the situation.
    They said theyl send out a letter to them and ask them to post it directly to the tax office.

    So they will help you out no problem.

    OP - just to clarify what is your last actual day of paid employment. ie are you finishing up and leaving on x date with all payments made then or will you still be in employment but on holidays until later in the month. If this is the case, the P45 can't be issued until after the last day you are employed by them, the ROS system will not allow a P45 date to be input prior to the actual date. I've yet to come across an employer who doesn't process a P45 asap as someone has left their employment - I'm not saying it doesn't happen but normally people like to clear files off their desks asap and it sounds like your employer's normal process date is at the end of the month and therefore 01 Sept is first date they can process it. Did you ask why they are waiting till then ?

    Indeed a P45 takes 5 minutes to fill out. There is absolutely no reason to make you wait until September.
