Eligibility question

    Hello,

    I am currently applying for long term residency under EU treaty rights. One of the qualifications is that my wife be able to prove self-sufficiency. On the form it says that a person shall not be self sufficient should they qualify for assistance under Part 3 of the Social Welfare Consolidation Act of 2005.

    Now, I've looked at Part 3, but frankly it's a bit confusing for me. So, can anyone tell me if my wife would be eligible for welfare assistance even though I am working and am making a good salary - enough to support us both. She is currently 9 months pregnant. She has been raising our other two children for the last 4 years and hasn't technically been employed, nor has she been seeking employment.

    I am hoping she is not eligible as that would help our immigration case. I'd guess she wouldn't be eligible considering I can support us both and our children, but would like to know for sure.

    I'm not sure but if the legislation states the person must not be eligible for social welfare then you should be ok. If she hasn't worked then she is not entitled to Jobseeker's Benefit and as Jobseeker's Allowance is means tested and you earn enough to support her then she wouldn't qualify for that either.
