How should I understand this rule in insurance t&c.

    My car was in accident some time ago. My insurance company informed me, that car was a category C write off (which means it can be repaired but it's not worth it according to them).

    Below a quote from my policy:
    Motor Tax
    We will pay the amount of the unexpired portion of the Motor Tax if You are unable to recover a
    refund from the Licensing Authority following total loss (which is insured under Your Policy) of
    Your Car.
    I got a phone call from insurance company on 1st July that car was written off.
    At this stage it was too late to apply to motor tax office for a refund of motortax, as first of all they refund only if there is at least full 3 months left, and in my case there wasn't as my tax was up to end of September 2011. Secondly they refund only if the car was already scrapped.

    Do you think there is any point for me to apply to my insurer for a refund of the unused portion of motor tax, considering my car was sold to the garage for parts. Or would I need some kind of certificate that my car was completely scrapped before it's considered a total loss?

    Obvious question is did you ring your insurer and ask them directly?

    Certainly wouldnt be any harm,worst they can say is no.
