    Hi all,

My boyfriend is in the process of being gifted a farm from his father. My boyfriend is resident in Northern Ireland but the farm is in the Republic of Ireland. His father never registered for tax in relation to his farming activity - it is only a small farm & would not turn over much profit.

My boyfriend wants to do things right & wants to register for Income Tax in relation to his farming activities. But we dont know if he needs to register in the North for Income Tax (as this is where he is resident) and also in the Republic for Income Tax (as this is where the farm is)? Or does he just register for tax in one?

I would be grateful if anybody has any advice regarding this situation.

I'm open to correction but AFAIK tax is payable in country of earning/gaining,
For example, If I own an apartment in Germany and rent it out, I'm liable for income tax in Germany, I receive a cert from German authorities for taxes paid which I put in with my Irish tax returns so I'm not liable for tax on the earnings as part of my Irish income.

It is the centre of vital interests.

In this case, where the farm is located. That is the republic.

Do NOT ask for tax advice on the transfer of the farm here, It is not allowed per the charter.

He can fill in a TR1 to register. A good port of call is the IFA (Irish Farmers Association) for assistance

Thank you very much for your help. I have already downloaded a TR1 to complete but as my boyfriend lives in Northern Ireland he does not have a PPS no - do you know if this is an issue?

He can apply for a PPS number at his nearest social welfare office using the address of the farm as the home address.

No hard rule. I work in the UK but live in Ireland and elected to pay tax in Ireland. Have paid tax here since 2006, can be problematic though (about to make a thread).

Re query, he would have to register for tax in ireland. needs to complete tr1 which can be downloaded from revenue.ie In relation to making a return will there be any income from farm and as regards gift/inheritance you would have to get value of farm to ensure it is under current revenue thresholds.

    hope this helps
