Just moved in - discovered the owner is in mortgage arrears

    We recently moved into an apartment (beginning of July) on a 12 months tenancy. We haven't yet received our tenancy registration letter.

    This morning I cleared our mail box, and mistakenly opened a letter that didn't belong to us. It was a letter for the owner, stating its a formal demand for the repayment of mortgage arrears of €13,000. It appears from the letter that the bank hasnt yet taken legal action, but the owner will be liable if the bank does so.

    I'm not sure what to do, and am obviously worried that we're going to come home one night to discover our apartment has been reposessed (and our posessions held hostage).

    Firstly, you have committed an offence under Irish Law by opening the post of another person. Moving swiftly on from that ....

    Secondly, this is not your concern you have a lease, etc. 13,000 Euro is not a lot in the context of property and automatic letters are written to scare people into paying.

    Thirdly, you should not come here seeking legal advice per the forum charter.

    Hi Tom,

    I wasnt requesting legal advice - just general advice - as I'm not sure what protections, if any, tenants have in Ireland. I only discovered this morning that we should receive a PTRB letter. I do think we have a legitimate concern though; I did have friends who came home from university to find their student houseshare had been repo'd by their landlord's bank, and they lost thousands in personal items that mysteriously disappeared, included laptops, ipods, xbox etc.

    And yes, I was aware that I had made a significant mistake opening the letter. Unfortunately I had sorted the mail into two piles - ours and unknown persons, and made a mistake.

    I'd be very worried indeed - presumably your rent is not being used to pay for the property. The owner may just have stopped paying it and is pocketing your money, waiting for the day the bank finally forecloses and you get booted out at short notice. Of course, it may not be possible for the bank to boot you out, but that's probably the worst case scenario. Plan accordingly.
