Copyright Infringement Query

    A friend of mine helps to run a website. They're in the process of coming up with a promo video for which I'm recording some vocals. He's thinking of using a piece of background music, which is of course protected by copyright, and I've been trying to ward him off the idea - especially since his breech would be in a commercial context. It's an Irish website and not that big a website.

    If he goes ahead and uses the music - what kind of fine could be expected for this sort of infringement if it was found out? Would it depend on the size of the label that owns the music?

    Well to be honest the short reply is that you might just be lucky and get a warning letter first. but in general the first notice you get in relation to copyright infringement can be a threatening letter demaning compensation.
    I know a guy who used what he thought was a creative commons photo as a cover for an EP and he got a letter demanding a couple of hundred for its use as well as proof it had been removed from all future releases of the EP. So its not just music you should be worried about.
    save your mate some hassel, record a few generic bars of chord progressions and stick it up as the music for his site

    if your mate is found out then its also possible that the company who host the web site may be contacted and they'll suspend hosting until the legal issue is resolved. They will see their potential liability and respond. Your mate ends up with no web site or is forced to move hosting repeatedly.
