I can't see how you could be held responsible, all you're doing is posting and I presume commenting on something another person has already published. Sort of like a reviewer cannot be held responsible for the content of something they review.

If you present the information as fact without attribution then I can't see how you could rely on somebody else's error as a defence. If you publish with attribution then you would probably be safe.

You'd be potentially liable for defamation.

Attributing it would make no difference.

In reality, if you're copying and pasting newspaper articles, any defamation proceedings would commence against the newspaper as the paper is the author of the alleged defamatory statement and is a mark for any award of damages.

That said, you could potentially be liable to a defamation action but if you are careful when publishing the articles, you could avail of the defence of innocent publication under S27 Defamantion Act 2009.

As said above, attributing the article would not allow you to escape liability in relation to a defamation action.

Would anything really happen if you copied and pasted newspaper articles that later turned out to be defamatory? Probably not but you could still be theoretically held liable for that defamation so you should bear this in mind.

cheers for input guys i think it might require some further investigation before i post anything.just one court case that stuck in my mind from a couple of yrs ago where the newspaper printed the name of a brother of a defendant rather than the defendant and he was successful in gaining money from the newspaper.
will have to thread carefully especially when the crooks seem to know the law better than anyone.biggrin.gif
