hi guys and gals not sure if this is write place to post this but anyway!

3 weeks ago on bonfire night to be exact i had my car parked near bonfire and me and friends were drinking all night and morning and i was honestly basically asleep from drink and at half 8am a neighbour came up to bonfire to say my car had been crashed and my friend at the time had been arrested for drink driving! i was too drunk to realise my car had even been gone! i then stayed in neighbours house for sleep the next evening i woke up and rang my friend he reckons i gave him keys to drop someone home and he told the gardai this?? this maybe true but i really honestly cant remember at all but i really dont condone drink driving so i find it hard to see?

well 3 weeks have gone by and ive heard nothing from gardai will i get in trouble for this or will they just be happy to arrest him for drink driving?
if the gardai question me i will just be truthful and say i really cant remember but i dont condone drink driving at all?
i have since fixed my own car at my own cost and no longer talk to this "friend"!

do you think gardai will get in touch before his court case? and what penalties would i recieve if judge believes i gave my keys to drunk uninsured driver?

thanks in advance! i have no prior trouble with law 4 years no claims bonus and really dont want trouble outta this

the damge was not too bad so it not worth suing for! i dont want any more hassle i just want to get on with things i just dont want to be put off the road if the judge thinks i gave my keys to a drunk uninsured driver as i heard this is an offence??

would the gardai not be in touch by now though after 3 weeks?

it was your friends responsibility not to drive the car drunk not you?

you didn't do anything stop stressing out, so what you gave him the keys or did you? you cant remember so he could of just stole them from your pocket you don't know and it doesn't matter cos your friend was the idiot behind the wheel

are you suggesting that gamblers should be stopped using boards.ie for free gambling advice and tips or are you suggesting that or gun owners should be stopped using boards.ie as they are getting free shooting advice? etc etc?

are you a solicitor that is out of work or something?

We're not discussing either of those two forums. LD has a long established rule, you can not seek legal advice here. Speak to a real solicitor. That is all.

    Pretty cut and dry.

Dont seek advice but ask the question what offence if any have you commited?

AFAIK you can be summoned to court for the offence of - no insurance owner - the offence being that you gave you vehicle to a driver who was uninsured and in doing so you invalidated your own policy. You mate will get done for drink driving and no insurance (driver). The summons in your case is not always followed up on but some gardai do. If there was no other vehicle involved it may help your situation greatly. If you tried to make a claim of your insurance they would be quick to point out that your insurance was invalidated unless your mate had an insurance policy of his own that covered his driving. You should see a solicitor!

what if he's friend took the car without he's permission, would that be treated as theft or is there another type of charge for that

if it was me and i couldn't remember what happened i'd say i was asleep and gave no keys to anybody and nothing else, leave the cops fill in the blanks
