Part 4 tenancy & new lease?

    hi, was just wondering could somebody tell me if we have to sign a new 1 year lease under a part 4 tenancy ,we are here 2 years.we want to do a month to month thing until we find another house which will be soon we hope but dont want to be stuck here for another year.

    you dont have to sign a new lease but legally you have to give more than a months notice moving out based on your tenure.

    D3PO is correct- no obligation to sign a new lease, but Part 4 has drawbacks as well as advantages, mainly it's more than 30 days notice at your tenancy age- 56 days if you've been there between 2 and 3 years: http://www.citizensinformation.ie/en/housing/renting_a_home/types_of_tenancy.html

    You do have to invoke the tenancy. If you don't and LL has started to advertise the property you must compensate him.

    Benefits one way or the other as already said.

    You would have to give him 8 weeks notice for leaving.

    Probably better of explaining what you want to do and agreeing it. Sounds like you should just try and get a place planned for when you finish.

    You are looking for two agreeable LLs one to keep the place vacant for a month and another to let you go month by month rather than hold you to two months .

    Better doing it now than leaving it till the students come back.
