Holiday Entitlements??

    Back working now 3 months but I want to take 2 weeks holidays wondering am I entitled to any of these wks paid or what way does it work. I know the norm use to be one day and a half for a month don't know if this still applies though, thanks in advance for any replies.

    Yes I think it still applies. If you are in a permanent job they will sometimes let you take the leave even if you have not worked up enough holidays ont he basis that you are continuing to work for them. Why not ask - I am a great believer in the saying if you don't ask you won't get. Enjoy your holiday!

    Did you get a contract for job. Should state what holidays you are entitled to. If you are seeking leave which has not been worked up most employers i have seent to be accomodating, more so with permanent staff.

    Your annual leave entitlements should be set out in your contract of employment. Where the contact is silent you are entitled what is set out under the legislation The Organisation of Working Time Act 1997 provides for a basic annual paid leave entitlement four weeks.

    There are 3 different ways of calculating your annual leave entitlement:
    • Based on the employee's working hours during what is called the leave year, which runs from April to March. An employee who has worked at least 1,365 hours in the leave year is entitled to the maximum of 4 weeks' annual leave unless the employment ceases during the leave year. Many employers use the calendar year (January-December) instead of the official leave year to calculate entitlement
    • By allowing 1/3 of a working week for each calendar month in which the employee has worked at least 117 hours
    • 8% of the hours worked in the leave year, subject to a maximum of 4 weeks
    An employee has the right to use whichever of these methods gives the greater entitlement up to a maximum of 20 days. An employee who has worked for at least 8 months is entitled to an unbroken period of 2 weeks' annual leave.

    An employer can refuse to pay an employee in advance for leave which has not yet accrued.

    In my location as soon as you start you are entitled to take all 21 days of your holidays, if your supervisor agrees that it will not impact the business.

    One guy I hired, started, worked one week then went off to climb Kilimanjaro the next week for charity. No problem.

    On the other hand if you leave having taken more days than your have earned it comes out of your final cheque.


    But this varies quite a lot by employer
