Neighbours dispute over equipment.

    Ok, I remember this happened a few years back between two neighbours. Never found out how they got it sorted.

    Neighbour1 borrows some equipment from Neighbour2. The piece of equipment was three years old and cost €350 euros at the time of purchase. Neighbour1 badly damages the equipment and tries to replace it, but the price has increased to €410 euros. Neighbour2 wants a new piece of equipment but Neighbour1 wants to give him €350 instead.

    How would this be resolved, who's right?

    Neighbour1 would only be liable for the replacement cost of an equivalent item - i.e. one that's three years old and in the same condition.

    If such a replacement couldn't be found, then the two neighbours should agree on a reasonable price, taking depreciation into account.
