    Hi All
    Ive an employee who is finishing up work this week after 1 year 5 months.
    Start date 1/02/10
    They have already taken 2 weeks holidays plus plus 4.5 extra days (paddy`s day, 2 bank hols in May, June Bank Hol and halfday for wedding) this year so what Im asking is have I given them more than they`re entitled to?

    No, assuming the employee was full time, the employee is entitled to a minimum of 4 weeks (20 days) holidays per year, plus the 9 public holidays.

    You will have to pay him for the holiday days they did not take off.

    If they were on an hourly rate, they are due 8% of hours worked.

    If on a salary, they are due 1.66 days per month.

    This is in addition to all the public holidays.

    In this case assuming full time salary the total holiday entitlement is 28.3 days.

    Deduct 10 days taken and you are left with 18.3 days due.

    I think you are wrong.

    Assuming holidays are a full calendar year. So what he did last year has no bearing.
    On the 1st January this year gets 20 days holidays if he works a full year.
    (Public holidays have no bearing in this discussion. If you are employed at the time of the holiday you get them if not you don't).

    So if he is finishing on Friday 8th Jul he was has worked 6 months this year at 1.66 days per month giving him 9.96 days and to be nice 10 days of holiday earned.

    As they have taken 2 weeks holidays (10 days) you owe him nothing.

    Now if he had worked until the end of July he would have earned 11 days of holidays with you owing him 1.

    If he left at the end of May he would have earned 9 (I rounded up for this example) owing you 1 as had already taken 10. You could have then reduced his final pay by 1 day.

    depends on company policy.

    Did the emplyee take holidays last year, is there agreement that holidays can be rolled over to following year.

    If its a case on no rollover, then as above its 7 x 1.66 ess 10.5 days taken = 1 day owed. (let them finish on a Thursday and pay til Friday.
