    Ive already posted thelink on the Limerick forums, but how crazy and bizarre is this??
    The jury has been discharged in the case of a Limerick man charged with attempted murder in the city last year, after the trial was unable to go ahead at the Central Criminal Court today.

    Mr Justice Garrett Sheehan told the jury of three men and nine women that there was no judge available to try the case, and he had to "regrettably discharge you as the case cannot go on".

    Twenty-nine-year-old Shane Mason, of Sean Hueston Place in Limerick city, had pleaded not guilty to the attempted murder of Daniel Philips at St John's Square in the city, on May 24, 2010.

    He had also denied two other charges of recklessly causing serious harm to Mr Philips on the same date, and possession of a firearm and ammunition with intent to endanger life in relation to the same incident.

    Mason was remanded in custody and the case is due to go ahead at a later date.

    the case is due to go ahead at a later date.

    Whats the problem? The defendant will be in custody for a little while longer, which sucks for him, but its not like they are setting him free or dropping the case. Judges get sick too ya'know.

    What about wasting all those jurors time. Kids etc. Absolutely moronic crap that would only happen here. If this happened in the U.S. heads would roll.Your response is typical of the excuses for everything bullcrap that goes on here. Where a murder is a manslaughter(out in 5 years for killing someone).The trial was for attempted MURDER FFS.

    Whilst the trial will go on at a later date, OP is correct in saying that this is very poor management that will lead to a lot of wasted time, money and effort by the great many people it takes to carry off a trial.

    In reality all the work that has gone into preparing the case will still stand, nothing material has been lost, the defendant will remain in custody, and this may add to his real prison sentance, should he be found guilty.

    If anybody, the person whom I feel has been most aggrieved here is the accused, who now has to wait a considerably longer time in prison to attempt to prove his innocence or to have judgement handed down.

    I agree, he too has a right to feel aggrieved. Still, the reality may be that 80-90% of the effort is done, but anyone who took time off work to show up for jury duty for example should also be annoyed.

    I think it's a symptom of a deeper mismanagement within the system, that's more difficult to quantify even than this.

    I said that he is probably the most aggrieved by the delay, and in fact I do think that any delay is unfortunate both for the victims and for the accused, yes, very much so.

    I am sure that the accused is as keen to leave prison as you are to see him in there. Which is where he shall be until his trial begins. What's your problem with this, again?

    I agree, and I wonder if this case might be dealt with a lot sooner if the long Harvest vacation were not an annual feature of the judicial process.

    Brilliant, you've used excluded anyone who reads this from the potential pool of jurors, and made a mistrial that little bit more likely.

    As this will be an on-going case no good can come of discussing it. Parkhead's comment about baby beating above is a prime example of why we can't have threads about upcoming or running cases on boards.ie because muppets say things that bias juries.
