How to find out who reported Welfare fraud

    A friend of hours was reported last year for working a few days and receiving SW .

    This man would like to find out who reported him .

    Is it possible to find out who reported him .

    btw - it was a case of mistaken identity and nothing was proven .

    No you can't as far as I know - thats the idea of it being confidential!

    No its not possible. Reporting welfare fraud is being encouraged, and rightly so. Your friend wasnt guilty, so had nothing to worry abou, theres no harm done, why not just let it go?

    I wouldn't say there's necessarily no harm done, it can be very distressful being the subject of a false allegation, especially if their payment is suspended pending an investigation. But there is not much that the person can do about this, these reports are confidential and are not to be disclosed under any circumstances.

    A person is however entitled to be told the gist or a brief summary of any adverse information that is used against them, and may be able to determine who the provider of the information was from this, although the Department are obviously supposed to ensure that the identity of confidential reporters are not disclosed inadvertently.

    A person is also entitled to request their file under Freedom of Information. Confidential information is generally exempt from freedom of information and should not be disclosed, but it does sometimes happen that information is disclosed that is not supposed to be!

    If the identity of the information provider was disclosed inadvertently, they may have a case for breach of confidence/negligence against the Department, and obviously the Department treat this very seriously as their fraud reporting systems would not be as effective if they were not confidential.
