Pay entitlements - HELP!

    Hi All,

    I am working for a company in Cork. I am concerned that I am not being fairly paid. I receive €1000 basic pay. I then receive 30% of the profit i generate for the company, which was slack for the last two months, barely making it worth my while being at work. I am also required to be on call 24/7 and carry my phone with me for emergency callouts. I get paid €0.56 per mile for mileage in my personal vehicle. My qouestion is this:

    1. Am I entitled to at least minimum wage as my basic salary?
    2. Am I entitled to pay for being on call?
    3. What is the current cilvil service mileage rate?

    I have searched google many times for information and all I can see is that the above cannot be taken into account in my wages, not if I am entitled to them.

    The company has a number of revenue streams and is in a very strong position at this time, the pace is relentless. My section is not purely revenue orientated, so a slack month profitwise does not mean the workload is lighter, in fact it is worse because you are working and making nothing extra!

    Any advice would be greatly appreciated.

    Hi John,

    Was this the contract you signed into? What are of business are you in? The 30% profit that you create for the company, is this influenced by other factors outside of you are or are you the sole driver of this?

    Thank you for your interest. The contract is signed but is up in three months, i will read it thoroughly at lunchtime. The work is related to repairs and maintenance on residential property.

    It seems that you may want to renegotiate the contract so.

    It sounds to me that you are not able to market the company or decide pricing therefore you are not really creating profit for the company, they are deciding that.

    Its a complex situation, but the question was really about the basic pay, on call situation and the milage, not the profit scenario. ssbob, have you a backgrounsd in this area?

    Our millage rate has recently increased from .56 > .7 for private vehicles apparently due to new legislation on depreciation.

    None of us questioned this :D so cannot show any links.

    Nope, but the figures I posted were for kms not miles, converted though you are still not getting the minimum for a sub 1.2 litre car for the first several thousand kms.

    Both of those questions are dependent on your contract.

    Depending on your contract mate, I have knowledge in this area.

    However, regardless of contract, is not everyone in the country [who works full time] entitled to at least "minimum wage" on their basic? Open to correction, obviously

    Payment of wages:
    All employees are entitled by law to a payslip. This allows you to check over your total pay before tax and all details of any deductions made from your pay.
    Rates of pay:
    • The minimum wage rate for an experienced adult employee is currently €8.65 per hour . An experienced adult employee is defined as being over 18 and working for two years or more.The reduced 2011 rate will not apply to current employees; only employees employed after the introduction of the reduced wage.
    • The minimum wage, however, doesn’t apply to young people under 18 or people in training. If you are under 18 then the minimum wage is €6.06 per hour.
    • From age 18 onwards you should be paid €6.92 per hour in your first year of employment and €7.79 per hour in your second year of employment.
    The National Minimum Wage law does not apply:
    • To anyone under 18.

    Nice use of differing text sizes. Fair enough. However, the employee still has to be paid at least the minimum wage in any "pay reference period", which includes over time but not time on standby.

    I would assume, in this case, a pay reference period would be a month, broken down hourly.

    Op, does your income [Basic, mileage, overtime, bonus etc] / the number of hours you worked in the month at least match €8.65?

    I brought my owm 07 vw Van to the job, its a 2.5 Tdi so they have a van on the road for 56c a mile as well
