Car accident. Advice needed.

    Hi, just need your advice on this please.

    It was in a minor car accident but just need to get another points of view and advice on how to deal with it.

    happened on parking. I started reversing, the was a car coming from behind (T shape road and i stopped to let it go. So it's passed by I checked around, the guy who was parked paralleled with me 2 parking spaces away was in the car and also ready to leave. As I was already in the middle of the road and start moving slowly to complete the maneuver. The next second i checked the mirror to see if there is someone behind heard the bump..

    the result my 03 audi A4 has few scratches at the side-rear part and part of light is gone also.
    the other car - 01 Peugeot 2006 - damaged wing.

    The position of his car shows that he was trying to make a loop to get around me (have some pictures taken).

    I think i was right and my car was moving already when he just started to move. But he seems to be sure that he is right also. So we called guards and they said they would tell us who's fault it was and we need to decide ourselves what to do.

    he has an "L" sign, so he might also have provisional driving license..not sure and have no idea how to find out that..

    So would you please advise on this. If i call insurance company, what are my chances to prove i was right? (have some pictures showing position of the cars). Also what is the chance they prove me wrong and my insurance will have to cover his damage?

    Friend of mine recommends to make a claim anyway, but im in doubts as it might affect no claim bonus...not sure how bad the impact would be though, any thoughts?

    I would appreciate if you share your opinions. Thanks!

    My opinion would be you should have been looking in your mirror before and during your reversing not after you started reversing.

    thats exactly what I've done, the was a 3rd car who i let go first. then checked everything and started moving...he didn't let me complete the maneuver.

    From every test I've done the reversing vehicle always has to give way, not sure what the law that's based on, but you get marked down if you don't yield.

    I'd say if you claim it would end up 50 50. Not fair, but unless you can get CCTV not much can be done.

    i probably didnt explain it well enough...
    he was coming from my right and i checked and knew where he was at the moment i started moving....than i check the other side - the road behind me...

    yes i was reversing, but the other car was starting from a complete stop and *!after!* i started moving..
    well i see probably you are right and i have no chance to prove it...

    I heard some where, some time ago that digital photos are not evidence, if you have them taken on a phone, or similar. Reminds me that I must get a cheapo disposable camera for my car.

    If I were you, I'd just be thanking my blessings that it was only another car that was behind me when I was blindly reversing, and not a child! In my opinion, you got off very lucky, and will hopefully be more aware of your surroundings in future. :)

    did i have to stop and let him go? all the way around me?
    i mean i thought it was just a common sense to let me finish the maneuver..?

    i was NOT blindly reversing i was totally aware of who/what around me
    but ok, i wanted opinions and that counts like one

    Without meaning to sound smart, if you'd been aware of your surroundings then you would have stopped as soon as he started moving towards you. I do feel for you, but you need to look everywhere when driving, not just in the direction in which you're travelling. Be thankful it was only a small bump.:)

    That's an interesting one. AFAIK RAW images are acceptable, but JPEGs etc aren't, but i'd be interested in seeing a link to proof of this.

    Common sense and the law are totally different beasts.

    The worst thing is you saw him and kept reversing. 100% against you for both cars, sorry.
