    Hi All,

    I used ebay for the first time about 2 months ago and was weary enough but knew it was a trusted and well known site especially when using paypal. I read reviews and read all the small print but still my item never arrived. I am over and back to ebay and paypal but they say its now TOO LATE to open claim and I should contact solicitors...police etc but in fairness am not going to, still I refuse to leave it. My item cost me €80, which I have lost, not a huge amount but too much to let go for nothing all same.

    Has anyone else had trouble and if so what did you do????:mad::confused:

    If it wasn't delivered you should have raised a paypal dispute straight away. What's the buyer saying?

    You still have time to claim a chargeback with your bank if the funds were debited from a credit card/visa debit card. The timeframe for that is 120 days.

    Hi thanks for prompt reply,

    The seller said that ebay suspended their sales..they sold and ordered in bulk and I did get emails first saying my product was delayed and I could cancel if I didn't want to wait.. but I decided to wait, unfortunately.

    I used lazer debit card so I dont think I have the same rights as if I used a credit card??!

    They did say it was too late but then said I could open the claim, when I replyed about this ( query about how to do this) they said they would get back to me soon, then when they did it was to say it was too late to do anything now.. in a long winded email!!

    You can't use a Laser card with Paypal, so that has to be wrong.

    You waited too long to start a dispute, and you refused the offer of cancelling the order. There's nothing else you can do.

    What kind of feedback does the seller currently have?
    IE, if the seller is a bit dodgy and has been suspended by ebay then there is a chance that other buyers may have opened disputes with him, in which case if you phoned paypal and explained the situation, if they could see that there was a problem with this seller and other buyers, then they may make an exception and help you open a case even tho you are outside the timeframe.
    As far as I can see its the only route you can take now, phone paypal and have a chat with them there, they are quite helpful.

    Yeah dodgy sellers but only know that now. Paypal had to help out a lot of buyers and I suppose deadlines are deadlines. I will see what happens with the bank.

    The card I used is a debit visa card (which is the lazer card).

    You can use a visa debit on paypal even though it is basically a laser card.
    Is the seller Irish ?? If so you could try the small claims court. Ring paypal directly , I think they are based in Waterford. I rang them when I was in similar situation and they were pretty helpful , it was not two months though. Thats fairly long. I am currently watching like a hawk something I bought last Monday on ebay that has not yet been posted. Have already started to harass I mean send :-) the seller emails on this. I am not used to this type of delay.

    Yeah good idea to keep an eye, I'm just not used to buying online so learned the hard way. The seller has an UK address I think. I tried to call paypal a few times but couldn't get through.. no. not in service, I should look it up again, obviously the wrong no.

    Laser is not Visa debit. Visa debit cards are completely separate from Laser, and offer different levels of buyer protection. A charge back is possible with Visa debit, but not with Laser. Enquire with the bank about the charge back process.

    Thats really good to know. As visa debits replaced our laser cards its a simple enough assumption to think they are the same. Hope this is the answer the OP is looking for

    You could post the email exchange or at least make it clear whether you're talking to eBay, the seller, or PayPal in the various mailings.

    Honestly, one way of reading it is that you were scammed. The seller took the money and fed you a line so that you wouldn't complain to eBay/PayPal until it was too late. However I can't say for certain as the events a little unclear.

    Ok Anyway I asked the bank if I have the same rights as I wasn't sure wit the visa debit card and she said yes. That is good to know, were we told any of this when they replaced the card.. maybe in small print!!!!

    Oh its clear that this was a scam alright. The seller took the money and told us it was the fault of ebay for freezing their business due to investigation and then advised us to go through paypal for our refund and if that doesn't work then try our bank, they even advise us what to put into the letter.

    Ebay recommend that I report the seller so that they can investigate and take necessary action. They gave me the customer support no. 080 0358 6551 to call them which I tried but this no is not in service. Is this UK no.?? Anyway they advised me to contact the seller but I know thats a waste of time!!!!!

    They are both debit cards, but Visa is far superior to to Laser. There is no buyer protection with Laser, where as there is with Visa. Much better to have a Visa debit card.

    Bank Of Ireland are supposed to be replacing Laser with Visa debit later this year. That will leave AIB alone operating Laser cards. I can't imagine that Laser will last much longer.

    ok, if its to our advantage then great. I do rem not being able to book flights online wit this card but now I can...at least wit most airlines. I was always just a bit nervous to buy online using the card in case I would have no safety blanket if something happened but I was just unlucky wit this seller I suppose. Hopefully the bank will help sort it!
