Legal bind of a deposit question?

    Went to dublin from cork last week to put a deposit on a 01 c180 coupe....deposit paid, due to be collected this thursday, just got a phonecall to say that the car has now been sold to someone else, after we had put a deposit on it. Anyone know where we stand legally with this?

    You're entitled to the return of your deposit.

    I was kinda hoping for the car more then the deposit :P Is the guy, a dealer, entitled to sell the car once a deposit is taken, papers signed, trade in accepted?

    It may be more trouble that it's worth.
    The country is awash with nice, cheap, cars. You'll get one somewhere, hopefully from someone more trustworthy than the guy in question.

    Get your deposit back and move on.

    i'll suss it out now, buying the car with my father and he's just on the way home now so i'll suss all the particulars.

    Reciept says: Reciept for sale of merc c180 sports and the reg along with the pricing and trade in details, signed by the seller with a warranty. Along with a handshake after the sale was made and the deposit put down and the promise that the car would be taken offline that day.

    If you fulfilled the conditions of the sale (pick up time) etc , then it is really bad form for someone to back out. However the legal fees etc would cost you more than its worth , if he's that kind of guy consider yourself lucky to get you deposit back.

    This isn't the reply you're expecting but if it's the C180 coupe then he did you a favour selling it to someone else, that car is a turkey as far as resale value is concerned. While the front looks like a C180, the arse of it looks like a Mazda 323 and they didn't sell too many of them because it looks like the halves of two different cars bolted together.

    Can you post a copy of the receipt (with your personal details masked) and name & shame?

    Yeah i'd say itll be a case of getting the deposit back and moving on. Plenty of other cars around with the hassle that goes with them of clowns like that. Just frustrating.

    it is still very annoying, you were happy with the car and the price for your own but it might be all for luck just get your deposit back and hope you are luckier with the next man

    Lousy thing for the seller to do and very dissapointing for you esp. after such a long jourhey to get to it. But, as others have said, perhaps for the best - c180 can give an awful lot of trouble and is a very soft car. Maybe offer it up as somthing that was not meant to be - what's meant for you won't go by you.

    Cheers for all the replies! Yeah calmed down a good bit now, get the deposit back, chalk it down as experience knowing that there are an awful shower of bastards out there and hope the next car goes better!

    If the seller did this to you, do you think he would be the sort to honour a warranty claim in a few months if you had bought the car?

    Did you just go to cork to see the car? I'd be pretty annoyed if it was me and the sale was agreed. I'd even try claim for travel expenses from him rather than just deposit back.

    Yeah from Cork-Dublin, Thats not a bad idea actually, deposit+plus petrol money, it was a sale agreed, deposit put down and receipt given so all in all its the least the scummy bastard could do.
