Constructive Dismissal Advice....

    Hi Guys,

    Anyone can advice me if I might have a case? Employer has increased workload since January (although it is not a new contract) very measureable difference versus others employed doing the same job. Have communicated the increased stress and pressure it has put on me, not sleeping, moody etc. Also, affecting my professional reputation with outside customers as things are falling through the cracks. Actually cant take it anymore, used to love this job. If I resign would I have a case??

    Any feedback is welcome...!

    As far as I know, and increase in workload doesn't need a new contract. The mere fact that the job became more stressful is not, in my opinion, a sufficient ground for a Constructive Dismissal, but circumstances play a vital role in this case.

    As CitizensInformation advises:
    • In a constructive dismissal situation it is for you to prove that your resignation was justified
    • You should use any complaints or grievance procedure that is available to you before resigning
    • You should also consider using any outside industrial relations procedures available to you before resigning
    • You should seek detailed advice before leaving as this is a complex area of law
    • You should only resign as a last resort after having used all available means of resolving the problem

    One personal note: in my experience, lawyers should be the last resort in resolving grievances, not the first. I'd strongly recommend to make your point clear with your employer and see if things improve.
