redundancy just got worse

    Hi there , i was made redundant in march 2011 after working with same small local company for 17 years and paying my taxes in full.The company was really struggling badly for approx 2 years prior to closure. My problem is that i did not receive my P45 and didnt get last years P60 and my old employer has done a runner - in severe debt to banks etc - so no point in telling me to contact him. I have probably been naive over the years as regards financial records etc from employer but things always went along grand until recently. I have not received any redundancy payment from either the employer or the state and i really need the money as my savings have been decimated and mortgage , credit union , credit cards , car loan are not going away. My wife still has her job but we are really up against it as we have 3 kids and no medical card entitlement as her gross pay is over €400 and i will only get dole for 12 months- any advice really appreciated:confused:

    As I understand it, redundancy payments are made by the employer not the state. If so, then since your employer has gone bust/AWOL, this is not going to happen. In any case, the important thing right now is to regularise your affairs so that you could claim dole/jobseekers if necessary, but also to sort your affairs out prior to your next employment. From what you've said you haven't done anything wrong, so it would make sense to first put together a picture of payments received to date from your employer (via bank statements), grouped by year, and then seek a meeting with Revenue to explain what happened, get a copy of their record of your employment to date and to get everything straight with them so you can move forward.

    Check out The Employment Appeal Tribunal website EAT look into cases like this and there is the Social Insurance Fund that can be used to pay your statuatory redendancy in situations where ex-employer cant/wont.

    from your redundancy point of view your only hope is that a liquidator is appointed by a creditor(or a group of) to the company. They will make all the necessary applications to wind up the company, This includes applications to the social protection fund for outstanding wages and to the DETI for state supported redundancy payments. Actually your boss can make the application for your redundancy but not any outstanding wages.

    second.... contact MABS immediately and they will send you a pack on how to deal with your money problems.

    they will advise how you sit down and write out each debt you have against your income.

    they will advise you to make letter contact(register of course) with each creditor you have asking them to reduce the amount you pay to them each week/month. you must make an offer its up to them to accecpt it. you get your offer amount by doing the following.

    they will advise you to do an income and expinditure sheet outlining the basics you need to live, mortgage(get this reduced on its own first before).esb,shopping,travel costs etc and then seperate what ever is left to be divided pro rate amongst your creditors ie your biggest creditor gets the biggest share.

    at this stage your letter will be a breakdown of the above and itemise all your debts to your creditors explaining where you are getting your offer amount to them.

    its now up to them to accecpt however going throught the MABS approach is usually accecpted unless a creditor refuses to believe some of your cliams for living expenses etc. However I am seeing judges agree with this process regardless of what the creditor wants.

    my wife and I are in the very same situation. good luck.

    btw going on the dates you quote its quiet possible that your employer didnt pay any PAYE or PRSI for you for 2010. The revenue wont come after you for it however it could affect your (if any) dole payments etc however it will be a paper mess more than anything.

    also you should quailify for Family income support. The treshold for a married couple with 3 kids with one income is 703 per week. You would be entitled to 60% of the difference between this figure and your wife's net pay.

    thanks spoonface ,redsquigy, sausages79 and gerrycollins- for sure I wont be as naive next time ,if there is a next time , touch wood. I actually cant say too much too bad about my ex employer as everything went hunkey dorey for years and it was a great place to work- he has probably lost everything , house- premises- reputation and he was in business for 49 years so a big blow to him and his.:rolleyes:
