New Laptop appears used/repaired

I recently bought a Lenovo S205 from an online supplier and when it arrived I noticed scratch marks on the power button, a pen mark on the rescue/restore button and the seal on one of the case screws had the impression of a screwdriver on it. I emailed the seller with pictures and they told me that because they are only a reseller and the laptop arrived in a sealed Lenovo box the issue is between me and Lenovo.

The laptop works fine, but as far as I'm concern it looks like a repaired unit and the seller should be sorting it out. Has anyone a similar experience? Am I over reacting?

That does seem contrary to the sale of goods and supply of services. Your deal is with the reseller. They bought from Lenovo, you bought from them. They are ****ing you about

    That's my feeling also.

What's your thoughts on the condition of the laptop?

It's unacceptable. I would call them up and demand a replacement/refund. the goods were not as described.

When did you buy and open the laptop as you should have sent it back to the seller asap after opening and finding it was not new!

You have an issue with the online retailer not the manufacturer.Contact your credit card or debit card issuer to pursue it.You will get the problem solved a lot quicker. Also, you should not have started using the laptop.

Don't forget under EU distance selling rules you have 7 days cooling off period from the date of you receiving the laptop during which you can cancel the purchase even for no particular reason.

Of course all EU law is moot if the retailer is based outside the EU.

Give it back and demand a full refund, as the reason why it was returned originally may come back to haunt you.

Stop using the laptop and arrange to send it back. Your problem is with the reseller not the manufacturer so i wouldn't play that game! You gave them your money, like other poster said the goods were not as described you are entitled to e refund or replacement
