    As the title says I was offered a position in a company through a recruitment company on Monday evening.Had the interview with the company last friday and was told by the guy in the agency on Monday evening
    "I should be back to you tomorrow with a confirmed offer. Its taken a while and a bit of effort to keep them moving so delighted for you.Talk to you as soon as the official details arrive"
    In the meantime he asked me to send him reference details and fill out the registration form for the agency which I did and sent back to him.
    Tuesday comes and I don't hear anything except for an email late on Tuesday afternoon saying "The finance manager in xxxxxxx was off site today so it will be tomorrow before I can confirm the offer but we should be able to nail everything off for you then"
    Again today didn't hear anything at which point I knew something was going on so I email the guy in the agency and he comes back to me and says "They called earlier to say the HR and finance manager would be calling me around 4pm with an update so I'll see what happens"

    So I get the phone call today at 4:30 from the agency guy telling me that the company is going with another candidate after offering me the job in the first place! He said that they continued interviewing after making the offer to me and that this is becoming common practice amongst employers. I'm absolutely disgusted at their unprofessionalism. Does anyone have any experience of a situation like this? surely this cant be legal? I though once an offer was made that this is a binding contract?

    Something similar happened to my gf a while back with a recruitment agency. Totally unprofessional!

    yeah but don't think it was the agency's fault. Agency got the offer from the company for me so it wouldn't make sense for the agency to dick me around considering they would of got their comission on me being hired

    Doesn't sound to me like there was a confirmed offer in the first place, sounds like the agency guy jumped the gun without confirming with the company.

    Some employers are totally all over the place at the moment so don't blame the agency. Thank your lucky stars you didn't end up working for such an incompetent manager.

    Completely legal unfortunately and even if you had signed a contract, the odds are that they'd have a very short notice period during probation so you'd only get a couple of week's wages.

    Yeah nothing illegal, but definitely email the company (copying the agency if you like). Tell them how disappointed you are etc. but also take it on the chin (i.e. asking them to consider you for any opening's in the future).

    My dad has a great story along these lines of how he got his first job. Same situation as you. Wrote a polite and professional letter (this was long before the days of emails) outlining his disappointment and how much he'd have appreciated the opportunity etc etc. They gave him the next job that came up and he worked there for over 40 years.
