Fairly crap weekend in this house and looking for advice.
We have car that was off the road for nearly a year. So no nct and tax was out of date. I got the form signed by the guards and sent it off to the tax office yesterday (never photocopied it). I stupidly told my other half he could take it to work since I'd sent off the form and booked the nct.
He got pulled over last night on the way home.

They impounded the car, which is fine, have gotten that part sorted.

So basically, car had no valid tax or nct and my boyfriend was on his 2nd provisional (no driver), which was out of date by 2 weeks but we never realised!

Can someone please tell me what happens now. I've spoken to a garda friend who said a fine of 60 euro for the tax which will come in the post.

Is there a summons for the nct and out of date license?

I will go into the tax office on monday mornings and chase the application I sent in and update his license.

Won't even be that stupid, ever again.

Talk to the Garda in question and ask him to give you some extra time to produce all your partners documents.

What was the end date that you put for being "off the road"? Before or after it was impounded.

Given that the car was stopped on the road with no tax, the Revenue could have an issue with the credibility of your claim that it was genuinely off the road before that date.

The driving with no licence may be a problem and it's lucky nothing happened as it would have had consequences for your insurance cover. A provisional licence that is out of date by 2 weeks means that he has no drivers licence. It's not a case of it being just "out of date". I'd kick his ass and say no car 'till he has a full licence.

BTW can you get a third provisional licence these days?

End date was the end of May. Last day of the previous month, so wouldn't have been claiming it was off the road for any portion of June.

Ya, you can if you have applied for or sat your driving test and can provide evidence to back it up which he has.

I don't think we need extra time as I'm hoping i can provide all within the 10 days. The license and tax can be sorted out by early next week.
I'm not sure of the waiting list for NCT but hopefully we'll get something. I'd be willing to travel just to get it sorted within a ten day period!

However will he not still get a summons etc on the basis that the effective date for the documents would be after the date he was stopped?

Obviously driving without insurance, tax, NCT or a license are all offences. It's up to the Garda in quesiton whether he prosecutes all of these or allows you to produce documents within a certain period of time. Try to get in contact with the Garda in question.

Thanks for the advice, all makes sense.

How would I find out the guards name? I did speak to him at the time but forgot to ask his name.
Can I speak to him as owner of the car or does it have to be my boyfriend? Who is useless at this stuff!

I never said I was surprised or that we were hard done by. We were in the wrong and will face the consequences, I'm simply asking for some advice on how to deal with it.

    Thanks for your input...

The money wasted on speed cameras in this country is an absolute joke.

What has that got to do with the price of spuds in China???

OP talk to the member and explain the situation, he might be a bit more lenient. See if you can get the form back off the tax office, they usually keep those on file. you might be able to get a copy showing that they recieved it, the offence is still non display of a valid road fund licence (Tax disc) but he might be lenient if you have documentary proof that you paid the tax and were waiting for the disc.

Thank you. I've done this. I went to the motor tax office this morning and got a copy of the form that I had sent through in the post which shows that I had gone to the garda station etc and got it completed and that it was off the road for the months previously.

I'm still not sure how to get in contact with the garda seeing as I don't have a name or station or anything like that?

The money would be far better spent pursuing and keeping people like this:
So basically, car had no valid tax or nct and my boyfriend was on his 2nd provisional (no driver), which was out of date by 2 weeks but we never realised!

    off the roads.

Speed traps are money earners so I don't see how they are a waste of money. In addition they are now operated privately so they do not cut into policing time at all.
