Property in separation case

    Case background:
    Father (58), retired, family home owned outright, primary carer to boy (7) and girl (3)

    married to

    Mother (40), working full time, wants to move out, take children


    Issue:
    Father owned the house outright before the marriage in 2005, was made redundant 3 years ago and has been full-time carer for the children since.

    If custody is granted to the mother, could the father be forced out of his house or forced to sell the house, even though there was never a joint mortage etc.

    I don't know if the wife has been entered on the deed.

    Should be noted, that the father has no other assets than the house, nor is he employable. If he is forced to liquidate the home or move out, he will be entirely dependent on social welfare.

    Any suggestion how this may be seen by the family courts?
