Getting arrested and your rights.

    Hi folks,

    I have never been arrested but what are exactly my rights if I did?

    I've being told that a garda has to read you your rights AND give you a physical copy of your rights. Does anyone know where I could download a copy of these rights?

    The Act governing this is the Criminal Justice Act 1984 (Treatment of Persons in Custody in Garda Siochana Stations) Regulations 1987

    I've linked the relevant section, "Regulation 8" as it is known. The notice itself is an internal document, and will be given to a person who has been arrested. I don't think you'll find it online.

    Edit, It does detail that the person will be searched, can request medical attention if required and will be provided a meal (if in detention long enough).

    They garda must give you a notice of your rights. It is called a form C72. I don't think it is online. They need not read the whole thing out to you but usually do.

    The most important parts are

    Information as to why you were arrested
    Right to have someone notified
    Right to consult a solicitor
    Right to medical attention

    The rest are mostly procedural i.e. Meals, searche, phone calls, bail, line ups, photographing.

    I dont think it is published. It isn't secret though. Im sure if you called down to a station they'd probably give you a look. It's basically just the Act that foinse linked but in a more condensed form.
