Immigration issue with work in Northern Ireland

    Immigration issue

    Hello all,

    My wife is South African and I am Irish. We got married in 2008 in South Africa. At the time we were living and working in the UK. She had a visa which allowed her to work there. We moved back to Ireland in December 2009 and we live in Donegal. My wife got work in Derry and was able to work due to still having her visa. But that visa expired in May. She did advise them of this and told them she was willing to pay for the visa but the company is the only person who can apply for the visa. She didn't get any feedback on this matter and now she's now been told that as the visa has expired they'll have to terminate the contract. She then phoned the immigration office and was told she'd have to leave the country (which is something she does everyday as she lives in Southern Ireland!!!). When she explained she only works in the North they said they never had this issue and advised her to contact a immigration solitior.
    She has an Irish ID card but can only apply for citizanship after 4 years.

    Has anyone come accross this situation?
    Does anyone know what she has to do to be able to work in the UK and live in Ireland?
    It seems to get a UK visa you have to live in the UK

    Any help would be appreciated

    My wife is South African as well and believe it or not you actually need a visa to enter into Northern Ireland even for shopping! It is the immigration Law which is really stupid seeing that i never see any border patrols asking for passports.

    My wife has an EUFAM stamp which I know excempt her from paying many visa fees however Uk I am not so sure! I will find out some more information and contact numbers and get back to you. We live in Donegal as well and know how frustrating it can be.

    Did her work give any reason why they did not apply? How long has she worked for the company? They will not be allowed to terminate her contract if they knew she was on a Uk visa.

    In my opinion your wife has a right to enter NI with her EUFAM card as long as you are with her or she is joining you. Same with any other EU country most countries in EU obey this rule, recent decision from UK first tier tribunal upheld this.
