    Is manslaughter becoming more popular of convicting someone instead of a case where it could be classed as murder?.

    yea I think it is, seems today you have to chop someone's head off and eat it to get a murder conviction

    I always thought manslaughter was if you accidentally killed someone, like knocked them down with your car, pushed someone down the stairs in the heat of an argument or that type of thing.
    But it seems to actually be unpremeditated murder. If you stab your spouse 20 times, you could get a manslaughter charge because you didn't intend to kill them, it was just a spur of the moment thing. Like, WTF? Murder is murder in my opinion.
    And there's no set minimum sentence, like there is for murder (as far as I know) so someone could be convicted of manslaughter and be out of prison in 2-3 years. :confused:

    Manslaughter charges should be reserved for those who kill someone without any weapon and obviously without intent. Eamonn Lillis was found guilty of 'manslaughter' after bashing his wife over the head with a brick.. 7 years is all the cnut got. I mean what was his intent, just to flipping stifle her? That sort of crap is murder, pure and simple.

    He might as well have been convicted of murder because the tabloids will pursue him to the grave so he's effectively on a life sentence for no other reason than because he and his wife were 'middle class' and living in a big house in Howth. If both of them had been alcoholics living in a council house and he beat her to death after a Saturday night row, none of the papers would have given it more than a passing mention.

    The legal difference between murder and manslaughter is 'malice aforethought' so if your defence can convince the jury that you didn't plan or set out to kill your victim you have a very good chance of getting away with the lesser charge.

    I don't understand why people can't see the difference. Murder is a pre-meditated event. Manslaughter is something unplanned - something that happens impulsively.. often referred to as a "crime of passion".

    The result is the same - in that someone is killed, but the motives & reasoning behind them are usually vastly different. They are both serious crimes, but manslaughter is the lesser of the two for good reason & as such is treated differently in the eyes of the law.

    Folks before we all go off on a mad one at the justice system, lets remember, the decisions to convict of murder or manslaughter rest with the JURY! ie, people just like us. Not to mention they have heard the case in its complete detail, not like the mob who read a tabloid and think they know better than the Judge and jury!

    The law is an ass.. if nothing else, sentencing here is disgracefully inconsistent. It's as if every judge is singing from a different hymn sheet. The judicial system needs major reform.. moreso than any legislative body.
