business name query

    if a limited company ,40 years plus, has a registered business name also,and is known only by the business name to the public and trades solely to the public under that business name ,can another company or sole trader also use the name as a business name ?

    the name was never trade marked

    Short answer = yes.

    RBNs can be registered over and over by various businesses. LTD companys - not so.

    Example:

    Fire in these 3 RBNs to cro.ie/search (registered business name - not company)

    161192
    161793
    177544

    all called 'books' but in 3 different counties

    Above is correct, but the new party may be passing off. A ten grand trip to the High Court to find out for sure.
