does statutory rape involve oral sex?

    if a 16 year old female gave a 16 year old male head (blow job etc), would this be considered statutory rape on the part of the male or does it have to be full on intercourse for someone to be under the age of consent?

    Oral is still considered to be sex, not sure about the age limits but if the girl was under-age it's statutory rape.

    The legal definition of sex is the action of penetration - which only a male can commit.

    Same reason why girls can't be convicted of rape, as far as I know.


    Edit - Actually, I read that wrong. The reason for the two quotes you gave were that the Government / courts don't want to make it illegal for a girl to have underage sex, because they feel that if they do then that will encourage abortions (because obviously if a girl under 17 is found to be pregnant then she would have broken then law).

    But for rape, a woman can't be prosecuted for the act itself because as I said the legal definition of sex is penetration. But they can be gotten on things like sexual assault, etc

    depending on how irish law defines sex and what is considered to be statutory rape, IMHO (not a definite legal opinion, just opinion) if she's performed a sex act on HIM, then surely if anything in an equal world, SHE is guilty of statutory rape of a minor, if indeed the law (which is most certainly an ass in this particular respect) states that performing a sexual act on someone below the age of consent is statutory rape (i.e. they are not considered old enough to be legally able to give their consent, even if they actually do so verbally) then that is what she has done.

    if he had performed oral sex on her, then i would expect it to be the other way around, but unless he forced her to give the blow job in the first place, then he hasn't broken the law as far as i can see unless the law sees both parties as guilty regardless of who performed the deed.

    either way, the law is fuct and needs to take into account that teenagers are going to experiment sexually as part of growing up and branding them sex offenders for doing what comes naturally to a post pubescent teen is about as wrong as it can get.

    It doesn't matter that she performed a sexual act on him, it's still considered S.R. in the eyes of the law. Now if he was say 15 and she was 17 she couldn't be done for S.R. as far as I know. The law is seriously messed up in that regard.

    If she did bring his "mate" to court the outcome would be an interesting one, I think in this day and age the case would be thrown out. But she could always claim she was raped and it wasn't consensual, then the dude is fcuked.

    The consent of the Director of Public Prosecutions is required for any prosecution of a child under the age of 17 years for this offence. A person who is convicted of this offence and is not more than two years older than the victim is not subject to the requirements of the Sex Offenders Act 2001. This means they will not have their name placed on the Sex Offenders Register.

    If they were both 16 at the time. It would come under Defilement of a Child Aged Under 17 (strangely enough by a child). It doesn't have to be full on intercourse.

    Would have to go to the DPP who is not very likely, at all, to pursue that case, assuming the ages of both parties are correct.

    As far as I know rape can extend to anytype of penetration, on either sex, and not just invloving genitaila.

    So if age is invloved I would assume it could come under a statutory charge.

    Section 4 of the Criminal Law (Rape) Amendment Act 1990...
    In this Act “rape under section 4 ” means a sexual assault that includes
    (a) penetration (however slight) of the anus or mouth by the penis..

    whats the story over here anyway... in uk the legal age of consent is 16 for heterosexuals ( 18 for homosexuals - i guess difference is to protect the vunerable) and has been for as long as i can remember... The homosexual age limit was higher when i was younger, but i believe was lowered from 21 to 18 a few years ago.

    16 seems legally perfect in my mind as you can leave school and get a job and get married... just cant drink or vote!
    however i think it is too old in human development terms... 14 would be better. But only if a comprehensive sex education system was implemented including social and emotional aspects starting from a very young age. (think this is done in australia)

    anyway just my thoughts:)
