Expected penalty for one or both?

    Hi there,

    Im wondering about the below Hypothetical Situation-
    I have to drive to a wedding in a different county.Im the designated driver.The other guy im taking along says that if im still drunk in the morning he will drive.

    Now heres the Crux,he isnt insured in my car.If hes over the limit(how can you accurately tell without the proper breathlyser) he takes the risk of both being over the limit and unlicensed.Its on him to take the risk but can i be penalised in anyway for letting him take my car?

    Ive seen this situation happen a few times and had a debate with friends but none of us are Qualified or Experienced to know the answer or expected utcome.

    It is an offence to allow someone to drive your car uninsured.

    EDIT: As for the drink driving aspect. Only an idiot drives while under the influence but it takes a special kind of idiot to get in the passenger seat next to him.

    Also a designated driver is usually someone who doesn't drink, not the person who might sober up faster.

    I agree.I was jsut curious could the person who let the other person drive his car be penalised as ive seen this and thought fairplay to the guy yielding to a sober driver and i wondered could that person be penalised for letting the sober driver drive his car.
