    Hi everyone,

    I will be due in court, and i will have a fine for driving without insurance over a year ago. (no excuses, made redundant) and i will happily pay the fine given to me.

    But im told it can be between 500 and 5000, thats a huge margin for a fine and im worried. there is a website that i can check previous judgements issue out so i can get a feel. its a first offence, only ever offense, i just hope it wont be 5k. anyone know of this site in question]?

    theres no way it will be 5k or anywhere near it for a first offence, i would say between 300 and 600 will be the fine.

    thanks for that dude, really worried, i could afford that. its more the losing my licence! my father was diagnosed with alzhiemers very recently and i will definately now need a car, are they strict on that?

    It will be in the District Court. There are no precedents available. The level of fine depends on the Judge. SOme go higher. Most go lower. If you need to keep your licence, get a solicitor.

    i was stopped a few years ago for no insurance and i got a 1 year ban so i would say you will be looking at a ban for sure.

    Failure to have motor insurance or driving without insurance in Ireland is generally punishable by:

    A fine of up to €2,500
    Disqualification of one year or more for a first offence and two years or more for a second offence, and
    At the discretion of the court, a term of imprisonment not exceeding six months.

    In the case of a first offence of driving without insurance, the court may decide in special cases not to impose a period of disqualification or to impose a period of disqualification of less than a year.

    Since 1 June 2003, where the courts in Ireland decide not to impose a disqualification, drivers convicted of a first offence of driving without insurance will incur 5 penalty points on their licence record in addition to any other penalty imposed by the court.

    Get onto your solicitor straight away about the circumstances and organise a letter from your dad's GP regarding his condition. You have as fair a chance as anyone of having 5 points applied to your licence in lieu of a disqualification. Have you any points on your licence at the moment ? By the way, fines are generally in the 300 - 400 range for first insurance offences, though other road traffic offences, (speeding, tax etc) will be taken into account.

    thanks guys for all the replies, much appreciated.

    I do have a solicitor, but she isnt working today and asked i call her tomorrow. He was only diagnosed, she doesnt know yet, but im sure she will mention it and provide the judge with his medical certs. Just now worried. hopefully i get a nice judge.

    I have no penality points, no convictions, driving or other at all, never been to court except jury duty

    Rely on your solicitor. I hope you sorted your insurance out as soon as possible after you were stopped by the Gardaí. The judge has discretion as to whether he/she imposes a ban and it will be up to your solicitor/barrister to argue that you should not receive a ban.

    Make sure you tell your solicitor any and all reasons why you require a car. e.g. work is far from home, ferry your father around, etc.
