Using own car for work...

    Hi all, hopefully you's maybe able to shed some light on my dilemma...

    I have recently started work for a company and they asked me if I was willing to use my own car, I will be given €600 per month tax free, I have to buy deisel with that.
    I emailed the secretary and asked her to verify I would be getting the €600 per month(tax free) and if she could send me some expenses sheets as I need to send in the deisel receipts.
    She soon replied saying that the €600 would be payed upon me sending in €600(max.) of deisel receipts only....

    I said that this couldn't be correct as I'm doing stupendous mileage(1k+ miles p/wk), plus my insurance, roadtax, wear and tear, servicing, tyres etc. etc.... depending on where I'm working I could be spending all of the €600 on fuel alone.
    She repied confirming what she said originally and that this is non-negotiable...

    Any advice, links to other sites etc. would be much appreciated.

    I don't think there are any rules, but that doesn't seem to be a great deal on the face of it. I get 50c per mile using my own car. Some weeks I do crazy miles. Sometimes nothing at all. A flat rate doesn't make any sense. Any other staff there doing the same?

    will the details of this €600 be in your contract or can you get the details in writing. Maybe the details were not given to you at first.

    most of us have to use our cars to get to work itself in the first place so there is a certain amount wear & tear we have to cover ourselves. Taking that into account getting your deisel paid for is not a bad deal but would also depend on your salary around that.

    ps are you doing 1k in miles or kilometers?

    Yes, I spoke briefly to another guy that's doing the same, he said that more often than not he spends around the €600 and above on deisel, he's been on a list for a company vehicle for ovr 3 months and no sign of getting one soon...
    We feel like we're being ripped off by our employers, how much tax will they be claiming back on those receipts??!!

    No, there's nothing in the contract about using own vehicle.
    Yes, I understand people need to use their cars to get to work but that is usually from point A to point B and home again, not touring the country going from call out to call out, north to south, east to west in a day!!
    1000+ miles per week, I'd say the average would be 1200 miles per week.

    What would happen if you are unwilling or unable to use your own car for business travel?

    I think it's a bad deal but I am not in your shoes. I would not supply my own car for this deal. Also, you need to upgrade your insurance since you wouldn't be covered for business travel under a normal policy. Ask youself how important this job is to you in case they let you go.

    If the condition of your employment is that you use your own car, your contract of employment should detail that under the terms and conditions. The contract should also detail methods of payments.

    I worked for a private company where the condition of that employment was that I use my own vehicle. That term was included in my contract in addition to the mileage rates that I was allowed (linked to civil service rates). Although my company was a private company, my mileage and subsistence (subsistence because I was away from my ordinary place of work) was linked to civil service rates. My mileage was calculated on Km travelled, and that was from my usual place of business, to any other place of business that was associated with my work. I was also entitled to claim mileage, if I was travelling from my home to another location that was not my usual place of business.

    You will have to inform your insurance company that you are using your own vehicle for purposes of work. I did not incur any premium increase because of this change of use.

    Under Health & Safety law, your employer also has a duty of care, whilst you are driving on the road in respect to this employment. On this point, under H&S law your employer is legally required to have a health and safety policy document, and because driving is part of the business, the safety statement should identify driving as an identifiable hazard of that employment. There should be detailed actions that your employer identifies and must take to minimize that risk, and you must be told of these. The H&S Authority would be able to advise you on this matter.
