DVD Trading thread

    A few people have brought this idea up over the years, so we've decided to give this a trial run. The idea is that you'll be able to trade unwanted DVDs with other posters. A few ground rules:
    • No Piracy, no downloads, no 'dodgy' copies etc...
    • No trading for money, that's what adverts is for. Only for trading DVD, Blu-Ray or VHS for DVD, Blu-Ray or VHS or possibly if it does come up other non-monetary item (film memorabilia, for example)
    • There's only so much control we can have over this thread, or more importantly the people who are trading in this thread. If a trade is dodgy, let us know and we'll see what we can do, but you're trading at your own risk really!

    Anyway, we'll give it a test run and see how it goes with the above in mind. Feel free to leave some sort of feedback on how a trade goes!

    Another US based site I use has a similar thread and Ive gotten some really cool stuff by trading that I may not have otherwise gotten or would have cost me a small fortune.

    I will dig through my DVDs later and see what I have.I know Ive double dipped for a few things,particularly when buying boxsets.

    All DVDs here have been paid for, I presume - how can that be compared with what has not been paid for (ie: illegaly downloaded films).

    Picked a couple of DVDs at random from my shelf and they clearly state "the unauthorized reproduction or distribution of this copyrighted work is illegal"

    Xtra Vision, Gamestop and everywere else are technically breaking the law every time they sell a used, second hand and ex rental DVD but it isn't enforced because it would impossible to do so.

    The is no difference to buying a pirate copy of a DVD or a second hand DVD as the owner of the copyright is recieving no income for his or hers work.

    Copyright Law needs a good kick up the bum.

Once a genuine copyrighted DVD has been purchased, money is paid to the copyright owners for the private use of that work, and provided you don't pirate it or start showing it in public, the DVD is then yours to do with as you wish. If you want to sell it on Ebay or give it away to someone, it's up to you. You are not breaking copyright law by doing so - rather you are transferring the license to a new user. As long as the original owner paid for the license, the copyright holders don't care what you do with it because they've already been paid.

    Re: showing in public. What's the deal with a few of these small screenings? I see a good few places having a 'film night' but have just brought a dvd and are just projecting it. I'm presuming nobody really cares?

    It strictly is illegal, but I'd be very surprised if anyone called them up on it.

    Yeah, technically to show a DVD publicly they have to pay for public showing rights.

    There is an exception to the public performance rule if an instructor shows the video in a classroom and the activity is a teaching activity and not recreation or entertainment. This situation would not be considered a violation of copyright law.

    What is deemed a Public Performance depends on if "a substantial number of persons outside of a normal circle of a family and its acquaintances" are attending and if the space it's been screened is open to the public [either by paid admission or for free]

    There is very little difference between the moral issues and legal issues when it comes to file sharing and second hand DVD purchases.

    The bits you've highlighted all have the proviso of "unauthorised" as a prefix, because there are certain rights that the licence-holders are not legally able to remove from you.

    The American version of this is called the first-sale doctrine. See here. Copyright holders of a certain type hate the idea, for the same reason that they hate the idea of libraries. Doesn't mean they have the power to actually remove that right from you with physical copies, which is why people get so up-in-arms about the way that digital media (via DRM and EULA restrictions) does remove the rights covered under first-sale doctrine.

    That I know of there's no hard-and-fast definitive legal version of the principles enshrined in the first-sale doctrine in any EU country (being as it's enshrined in US law, but not elsewhere) but neither is the exercising of those rights demonstrably criminal or unlawful.

    Your own highlight says lending which this thread is not aiming to do. People are exchanging DVD's for other DVD's which is not the same as lending. You can legally resell original copies of copyrighted books, DVDs or software, you cannot sell any items that would violate the copyright laws of that item. So, for example, you can sell an original copy of the Star Wars DVD, but you cannot sell a copy of the movie that you taped off of your VCR nor can you sell a copy of the DVD you made. The copyright information at the start of DVD's is a very abbreviated version of copyright law. For example most DVD's in Ireland have a copyright warning claiming that performance in schools is prohibited but Irish copyright law actually has a provision that showing "for the purposes of instruction" (i.e. for educational purposes) does not constitute infringement of the copyright of the work.

    Hmm, really think this thread should have a lot more activity :/ Any ideas on ways to improve it? The only one I can think of is to have an opening post that contains the users willing to trade and a list of the dvds/blu-rays they have to offer. People would need to drop a PM to the person making the opening post with any updates etc.

    Just think it's easier/better than the way it's currently set up.
