Previous owner has not handed over 'Change of Ownership' form!

    Hi,
    I'm new to this so sorry if I've posted in the wrong place!
    I bought my first car exactly a month ago and I still don't have the car registered in my own name and address although I am insured. The woman I bought it off was not around when I purchased it as her mechanic was doing a job on it and I took it from there. I have contacted the woman 3 to 4 times since buying the car asking her for the logbook, form and spare key. She has now emigrated and there is stiiillll no sign of my logbook, change of ownership form and spare key:confused:. Is there anything I can do about this legally? and would I get in trouble off the Gardaí for not having the car registered in my name and driving it around? I have a feeling she isn't bothered by me calling her as she has got her money for the car.
    Someone help me out!!

    Think of the positives. You're immune to speed cameras and toll bridges now! :)
    You could tell the woman that you're planning on taking a few hundred trips through a toll bridge and that she'll have a hefty bill when she decides to come back.. :)

    I do think there's a means of getting it registered in your name though if you can prove that you've bought it (receipt etc) and the other party is unwilling to transfer it over.

    Did you see the logbook when buying the car?

    The previous owner may have sent the Cert on and it got lost in the post. Phone 061364901 Dept of Transport, explain you are the new owner of the car, give them the reg number. If they say it's still in the last owner's name you will need to get a RF134 form at the Garda station, stamped by a Garda. It is an application for a new Cert. Strictly speaking, only the last owner should be able do this, but Gardai don't care in general and will stamp anything to get back to real crime...

    Go onto www.cartell.ie and do a history check. It will tell you when the ownership was last changed, which may help you. You can also do this on the motor tax website, but cartell tells you if there's finance outstanding or if it's ever been written off etc.

    Do what the previous poster said - advise the last owner that you are going through the toll repeatedly.

    The cops won't take the car off you so long as you're insured, but you will need a new cert to tax this car...

    Not you won't. You can go down to the Motor Tax office and tax it straight away no problem without any registration cert.
    All you need are details which you already have... make/model, colour, chassis number and registration number, and the fee of course.

    you're supposed to do that alright, or a solicitor can do it. I've had to get taht done a couple of times, mainly with old cars though where the person on the reg cert is either deceased or otherwise unavailable

    Did you actually signed the registration certificate last page with new owner details, or you never even saw it?

    Remember, that if you didn't you are not a registered owner. Therefore as most insurance companies require you to be registered owner on a car you are insuring, most likely you are not insured.

    Second problem I can see is that you can't drive anywhere abroad, as while travelling abroad, you need to carry your registration certificate with you at all times.

    I'm not aware of a single mainstream insurer in this country that requires the insured to be the registered owner. Stop scaremongering.

    The previous owner isn't required to give you the VLC, they are supposed to send it to the Dept of Transport in Shannon

    All insurers that I was with so far required the car to be registered in my or my spouses name.

    First example:

    Thanks for the help! I'll try that tomorrow! Yeah I would go up and down the toll but she's moved away so she won't even recieve the fines :mad: I've never even seen the logbook or anything! I bought the car taxed but its up the end of this month! Thanks everyone for the help! I'm stressing out here!!
