JSB question for travelling

    I've been on JSB the past few months...only getting 1 day a week work. A year ago I decided to go travelling, so I'll be heading off for 6 months.

    I would like to know what will happen to my JSB when i return(if) I do come home?

    Boss said he'd still be able to give me 1 day a week. Will I be able to reapply for JSB?

    Also, will I be entitled to get any holiday pay on the JSB for the first 2 weeks I'm away?

    Sorry if this sounds abit noobish, but I'd just like to know what I'm coming home to if I do return.

    You'll probably not be entitled to Jobseekers Benefit when you come back. The issue here will be the "substantial loss of employment". To be eligible for JB, you have to have lost at least one day's employment. They can look back 13 weeks (and sometimes up to 26 weeks) for the loss of employment, but if you're away for 6 months, and presumably lost your full time employment some time ago, then you'll not qualify. If you got a few days work after you came back, and that was subsequently reduced, that would bring you back into it, depending of course on your contribution record.

    If you find that you're not eligible for JB, you could apply for Jobseekers Allowance, although that is means tested, and also you may have difficulty by being out of the country for a while. You may find yourself considered not habitually resident.

    IN short, you cannot depend on a social welfare if you take this holiday.

    On the holiday pay issue, you will NOT be eligible for this, this only applies if you still meet the criteria for payment, and as you will be away for longer, you will no longer be genuinely seeking and available for full time work, so won't get any payment. Holiday pay is only paid once you return in any event, so if you didn't return after the 2 week period you don't get the payment.

    Look you will be heading away for 6 months not 6 years so you will be able to claim jsa after a means test, the habitually resident wont come into effect unless you are out of the country for over 2 years, i was away for nearly 2 years and came back and i was able to get dole with no problems.

    Not true, if you are out of the country for any period of time you will be assessed for habitual residence. Chances are OP will be fine, but they shouldn't count on it!!!! Just because one poster didn't have a problem doesn't mean that the OP won't.

    Appreciate the replies guys.

    Was wondering what I should do in terms of before I go. Im going next week, but have 4 slips that arrived today to fill up, which means I would be able to get JSB for the first 3 weeks I'll be away in the states.....A family member would drop the slips up for me if I wanted.

    I know this isn't the right thing to do, but its an extra 3 weeks money I'd get if I was in the country.

    What would the office do if I suddenly didn't drop up any more slips...would I be auto removed or would they ring me up looking to see whats going on and why wasn't I dropping up anymore slips?

    This sounds bad I know, but I'm sure everyone's thought about it at some stage in my situation.

    Of course you cant fill in the slips as that would be fraudulent. if and when this is discovered you will not only be in an overpayment when you come back, you will have problems then accessing a SW payment, you will have to pay the money back and you may even be fined. If you are going away for 6 months, just accept that you cannot have a SW payment when you are not only left the country, but not looking for full-time work.

    silentbunice, that would be fraud, and not to be discussed on this forum please.

    The substantial loss would not come into your Jobseeker's Benefit claim, if you have the required contributions you can go back onto JSB - if you make your claim within 6 months of your previous JSB claim closing they will link to each other, and the substantial loss of employment cannot be considered until your claim expires.
