Shop Possibly Closed for Queen, forced days hols?

    Hi,

    There is talk of my place of work closing on Friday due to the restrictions in place in Cork city centre due to the British Queen's visit... now its being say they will take a days holidays for the privilege of this, my question is are they allowed to do so? I am ready and available for work so its not my fault?

    My contract of employment has this in it:

    "Your normal working hours are 9.00am to 5.30pm (1 hour lunch break) for five days
    from Monday to Sunday with the days determined by the Company. Your pay structure
    includes the fact that you may be required to work Sundays. The Company reserves
    the right to alter these working hours from time to time, dependent on the needs of the
    business. You will from time to time be required to work overtime depending on the
    requirements of your work. Where possible you will be notified in advance."

    However I only ever work Monday to Friday. I suppose if I pushed the issue they would want me to work on Saturday?

    A company has always had the right to decide when you take holidays; in general they don't enforce that authority though and let you decide when you want to take them.

    As Nody says, strictly speaking it is up to the company to decide when you take holidays, not you (reasonably so). However because of the logistical pain of this, most companies allow employees to choose their own holidays.

    The company is required to give 30 days notice of any mandatory leave, however given that the company may not be sure of whether it's feasible to open on Friday because traffic management information isn't fully available, I think it's reasonable of them to give you advance notice of possibly having to take a day's leave on Friday.

    we had a situation like this at work last summer, our boss wanted us to take holidays on the friday and he told us on the tuesday, one person there rang nera the employment rights place and seemingly by law he has to give you 30 days notice to take annual leave, otherwise he has to let you do your job or give you a paid day of, we got paid day off :D
