Legal status of school uniforms

    Hello all,

    I am dragging up an old thread here as it is of interest to my wife and I.

    As a result of the implosion of the construction industry I am joining my wife in her small embroidering business. We are currently at an advanced stage of constructing an online school uniform site. It is our intention to supply quality school uniforms to anyone who wishes to purchase at a very substantial discount to what people are accustomed to paying.

    My question is; As a parent does one have the right to order their crested uniform from anyone capable of producing the crest?

    Our site is currently being constructed with a number of local schools for which my wife is already on their 'list' of suppliers. However we can supply any uniform with any crest to anyone and intend to develop the business in this direction. It seems nobody is clear as to the ownership of the crests.

    It would seem to me that a parent should NOT be restricted as to where the uniform/crest is purchased.

    All information on this is appreciated.

    It would seem to me that the rights in the crest would clearly belong to the school.

    That said, there are very few schools which would not be willing to have an extra supplier on board.

    I would be looking at ways of engaging constructively with the schools. For example, some sort of marketing discount, or some sort of arrangement for supplying a limited number of discounted uniforms to people who can't afford the full price.

    In the case of our primary school the rights to the crest are with the School Wear Center as the designed it. We as a Parent's Asscociation had tried to supply sew-on crests, but couldn't because of this.
    Having said that, our school doesn't insist on the school uniform having the crest. As long as the sweater and the track suit have the right colour it doesn't matter whether they are crested or not. I have been buying M&S generic uniforms for years now as I find the quality so much better.

    Next year all my children will be going to Secondary and the uniform has to be crested, would love to buy it elsewhere as I find the quality of the crested sweaters supplied by several local shops pretty low :mad:

    That's a clever one for the School Wear Center. The OP could get around this by designing a completely different school crest, with the school's approval.

    Best of luck with this one. My daughters' school is Arnotts only, very expensive and quality only reasonable.
