How long to get p45 and wages?

    Hey guys, my friend has just been let go from his job at Concern. Just wondering, how long does he have to wait to get his owed wages (in the region of 900EUR) and his p45? HE requested them as soon as he was let go but they refused, saying he'll get his wages in 3 weeks and his p45 "when they have it." Is this legal?

    An employer cannot refuse. Although there is no length specified to comply.

    Theoretically supposed to receive your last payslip and your P45 on the day that you leave.

    In reality, many employers don't give you either of them until the next payroll run. So if you're paid monthly and you leave at the start of the month, they don't pay you or give you a P45 until the end of that month.

    It's not legal or illegal, really. If he makes enough of a fuss they'll probably pay him and give him his P45 just to get him to go away.

    As said though, he's entitled to a P45. If he doesn't have it within a week of getting his last payslip, he should annoy the employer. If they're not being helpful, then a quick complaint to revenue always gets things moving.

    This is mean-spirited if your friend gets paid weekly.

    However, if they usually get paid monthly and you're referring to the 3 weeks between now and the end of the month. If that's the case (why didn't you just say so!) they'll probably wait until the payroll is done at the end of the month before paying your friend and providing the P45.

    The P45 can take even longer if they use a separate person to prepare it than the person who does the payroll.
