Paypal Case Initiated 3 months after Sale

    I sold an item on eBay on the 6th of March and sent the same day. Now on the 6th of May a case has been opened against me with a chargeback from the buyers credit card company!

    I don't think I have the proof of postage still and dont know what to do as it is for €400.

    Anyone any ideas??

    I believe Ebay/Paypal have a facility that allows you register the tracking details with them, always do this or at least hold on to your receipts for the length of time, after which you can no longer be liable. Card companies will allow customers to make claims within a certain time frame and this period will vary from with each card company, usually around 3 months.

    Without proof of shipping tracking info :rolleyes: I'm afraid it's not looking favourable for you and occasionally proof of shipping isn't enough anyway.

    Did the buyer leave feedback? I assume you had no contact from them, it could be a case of the buyer no recognising the charge, so would be no harm contacting the buyer and querying if they were satisfied with the transaction, don't mention anything about the charge back just yet.

    He's no longer registered on eBay and the 90 days exactly stinks of a scam!

    Will have to try root out the receipt when I get home.

    Just had a quick look through my mails while I was writing this and found that paypal had done a review and cleared it as ok to ship so if I find the receipt I have to be ok?

    proof of postage is no good - it doesn't show details.

    did you track it at all - for an item worth 400e - you should have tracked it.

    If you tracked it - the Post office will have details - ie on a date - they log the number and destination.

    By proof of postage I mean the receipt with the tracking number by registered post. I do always throw them in a drawer so fingers crossed

    Your local post office may be able to help you out - they have a record locally of all parcels shipped so if you can specify the day you sent it they should be able to get the tracking number for you.

    BTW Your OP says 3 months and you've mentioned 90 days but 6th March to 6th May is only 2 months.

    Thanks for the info on the post office. I might try that if i can't find the details.

    I actually remember feeling dodgy about sending the phone to him as he was a new member at the time and then feeling reassured as paypal had done a review and cleared to ship.

    Unless things have changed, you're in trouble. If you have money sitting in your Paypal account get it out now or you could lose that as well.

    Paypal don't care about sellers .... check out paypalsucks.com. They will freeze your account and any money in it.

    I sell quite a bit on ebay so they already hold 15% of everything I take in for 60 days in case of disputes etc. Worried because I had another guy in Russia buy nealry a grands worth of stuff and hes no longer registered. Definitely have the tracking numbers for those though and specifically remember checking I was eligible for seller protection.

    Ive had a few other run ins with them as well, recently selling an item, the buyer picking it up, then a chargeback being initiated. I had no proof the buyer got the item so lost the dispute.

    If I was a scammer there'd be easy money to be made out there.

    If it was a credit card chargeback that initiated the claim, then you're in trouble. This would only happen if the purchase was made with a stolen card, or Paypal account. Even if you do have proof of delivery, it will not work against a credit card charge back, only if this is a Paypal claim. If this is a Paypal claim, then I believe you need to have shopped to a Paypal verified address in order to qualify for seller protection.

    You are pretty much going to lose this one. This is why Paypal is very bad for sellers, there is practically no protection against fraud. A seller has no way to verify the legitimacy of the card holder/purchaser, and Paypal will not take the hit on fraud, so the seller loses.

    Your only hope is that if you have already spent/withdrawn the money, then remove your card details from the Paypal account and stop using it. Otherwise, Paypal will charge this amount to your credit card, or take it from your funds.

    Found the receipt anyway withthe tracking number saying it was delivered. I cant see how they cannot cancel the claim against me when I have email evidence from them saying they had reviewed the payment and it was safe to send.

    If it was an eBay sale and you shipped to the address supplied by PayPal you will be covered. Although chargeback's do take ages to get resolved

    Yeah they've said it could take up to 75 days. Painin the ass but what can I do!

    Clear your paypal account and delete your card details.
