Speeding fine help/Q's

    Hi,
    just a query on behalf of a friend of mine who just received a fine for speeding (59 in a 50:o) on a road he is pretty sure he wasnt on that day but cant say for certain,it was on a route in a Limerick city, heading out the N24 on Mulgrave street near the prison, the picture was taken from the rear and when he asked the local garda station they said it was'nt their cameras so must be private ones.
    I thought they only pictured you from the front to prove who was driving.
    Also the first name issued is missing a letter , and I remember somewhere if any mis-spellings are an auto dismissal?
    any help?

    Nope pictures can be front or back. I had a mis-spelling on my notice as well and it made no difference.

    If he wants to dispute on the basis of the missing letter from his name, he can always take his chance and go to court.

    In my case - wrong spelling or not, I was speeding, I got caught, I paid up.

    Photo can be front or back. Anyway, what does it matter? Was it his car?

    As for the missing letter - he can take a gamble on court but would probably fail and face double fine and double points. Also, if he was speeding then let him stand up and take the punishment instead of looking for a loophole.:mad:

    Start off by telling him to ask for the photo of the car so he can confirm it's his.

    and if it's confirmed as his car, Ask if he let anyone drive his car.

    If not then pay the fine.

    If he let someone else drive the car and there is no proof ( in the photo) he will have to try get that person to admit it.

    thats the thing ,he's pretty sure he wasnt on that road that day and no-one else drives his car, has asked for the picture so will wait and see

    On the speeding letter there should be a reprint of the numberplate.
    That should show you if it was the car in question.
    If it is, little can be done. And trying to get off on a technicality (like so many "clever" people) will most likely result in double the fine and points.
    If you are absolutely sure, do ask for a picture. And don't get fobbed off, I have a feeling they will try, but a little (or a lot) of gentle persuasion, or a lot of nagging, will certainly help.

    There is the possibility of the car being cloned. However as your friend is only "pretty sure" then there remains a good chance it was him ( I guess he does travel this route occasionally). How flukey would be that a cloned car would travel the same route!
    Better photo is essential for more clues.
