Ebay - Is this my own fault?

    I order an item(Value = £9) from a seller on 22nd February 2011, I completely forgot about the order until today and realised it had not arrived:eek: I contacted the seller who replied to me:
    We keep proof of postage (for insurance reasons) for 45 days, this gives customers a good amount of time to receive there order, and in the unlikely event of a loss, a claim can be made.
    As its some 70 days (plus) we cannot make a claim and any report of loss would have needed to be reported well before now.

    I sent several emails back to the seller but he justs sticks by this.

    I tried to launch a dispute through paypal but was advised that it was not possible, no reason was given, but I suspect it was because the transaction is so old now.

    At this stage, apart from leaving him some stinking feedback is there anything I can do or should I just forget about it and put it down to experience:( Is it my own fault for forgetting about the order?

    Incredibly this is the first time an item I've ordered has not shipped from an ebay seller!

    Yes it is your own fault and you don't know if the item was shipped or not It could have been shipped and signed by your next door neighbour

    It was shipped to my office according to the seller but I never received it, I have received other items from other ebay sellers ordered around the same time that were delivered. But I think you're right, it's my own fault for forgetting about it, lesson learned meethinks:o Cheers for the feedback McLoughlin.

    Yes, 100%. 45 days is the limit for starting a dispute in Paypal, hence you can't do it now. The seller doesn't really deserve negative feedback either, as it is too late for him to try and help you now, and this is your fault and not his.

    You don't know that's the case at al though. It's far more likely to have gone missing in the post, or at your office.

    Yes, was wondering whether to give negative feedback or not. Won't do that now:) Guess I should just forget about it at this stage.

    Well actually I'd give neutral feedback! How can you have an opinion on it, you got nothing! It sounds like he's a business seller, so to be frank he should have volunteered a refund or replaced it. Well that's always been my experience anyway. The timeframe shouldn't matter.

    But it doesn't seem like he will do that, but neutral feedback will indicate that even though you're not happy, you're not so unreasonable to leave a negative feedback, but that you do in one way or another question their service!

    Well that's what I'd do, but in fairness I've never left negative feedback, and only once have I left a neutral, but then again, maybe I've been lucky :)

    Can I hop in here with another question?

    I bid and won on an item on ebay last week. Goods £44 and postage from UK to Ireland £15. All done and confirmed by ebay and paypal. Then i get an email from the seller on Saturday morning saying that when he went to the post office postage was £19.46. He wants me to send on the balance! On the sellers add it said postage would be between £10 and £15 so I was kind of suprised by the email! i have emailed ebay to ask them whats what but no response. A bit tight I thought asking for £4!! Any suggestions or similar experiences?

    @Slightly Bunkers. The seller should really have checked his costs a little better. I've never asked a buyer for extra if I miscalculated the postage, my fault and it has cost me, don't use ebay to sell stuff anymore as they really only want business sellers, and their charges are way too high for a private seller.

    You can always cancel the transaction as the seller has misrepresented the postage costs. If he's a private seller and you want the goods, suggest a split of the extra charges. If he's a business seller I'd request a refund and look elsewhere.

    Saying the time frame shouldnt matter? It has to. What if a buyer comes back to you in 11 months saying item never arrived even though they actually got it a week after you posted it? That should be ok, as the time frame does not matter?

    What more can the seller do after posting it? Contact every buyer to see they got it? Its up to the buyer to keep an eye on any online ordering they do.

    I dont see why a seller should refund after more than 2 months, its hard to see how thats your experience, your saying you left items that long before asking where they were? Then got a refund?

    You might have been lucky, but postal services are not flawless, therefore there has to be some timeframe to work to, otherwise you sell something on ebay, the buyer receives it, but now just has to wait more than 45 days, then claim it never arrived. So a set time is needed.

    I guess if you order something, you wont mind if it takes 2 months to arrive, and wouldnt be checking it out after a week or two for example, to see where it is?

    A bit tight alright on their part. They should absorb the extra postage i believe, as they showed what the postage was going to be, and should stick to that now. Its up to the seller to have their postage fees right.
