Licence Agreement

    Hi, Im looking for advice on licence agreements. For the past 12 years we have been using a premises for work. However during this 12 years we never signed a lease/licence agreement. I presume that an agreement was signed in the beginning but neither I nor the landlord have one to prove this.

    For some strange reason our landlord in now pushing us to sign a new agreeemnt which states that when the licence agreement ends (just say 2015) that they would be entitled to kick us out.

    I have heard from other people that we as a Ltd business do have some protective interest (squatters rights) on this premise. I would be delighted for any advice or similar expereinces you may have.

    Any opinion that is expressed here cannot be regarded as legal advice in any way. You should go to a solicitor considering the potential implications. What I will say in general is that there can be no question of squatters rights unless you are there without permission and the distinction between a lease and a licence is one of substance rather than form; a court could declare a lease what the parties thought was a licence.

    1. Write out a full statement of your dealings with the landlord about this property.

    2. Make copies of any relevant documents, details of anymoney paid etc.

    3. Bring to your solicitor.
