    In a legal separation / divorce, is an affidavit of means always required or just when one party is seeking financial assistance from the other?

    You need an both affidavit of means and welfare along with a Civil Bill for divorce.

    I am not sure what the position is with a separation agreement I think you may need the affidavit of means and welfare you defiantly do not need the Civil Bill.

    The Judge needs to know that both parties are adequately provided for, given their means.
